    Default Whether Gender equality possible in law?

    Constitution prescribes Right to equality.

    Labour laws says equal pay for equal work

    civil laws says - you can not send a woman to civil jail under execution
    proceedings when recovery of money cannot be made from her. - But men can be sent to civil prison.

    Criminal laws says - you can not send a woman to jail for adultery - But men can be sent to jail.

    Whereas both civil and criminal laws have given it in favor of women - whether gender equality possible?

    That’s the main problem of the society. Why are we thinking if gender equality is possible in law or not. Of course it is and we got to legalize it as soon as we can. It should also amount to no reservations…of any kind. All citizens are same, so why give more opportunity to some and avoid the rest. Discriminatio0n is created this way and not how it does exists.

    Though the government talks more about the gender equality, but somewhere it is limited only on papers, but never in practical. The law should be enforced equally on everyone. Sometimes, the law favors women and in some cases it favors men, then how come we can say there is equality. Equality should not be gender biased, whether it is for support or punishment.

    Technically it is same for all, men or women, but somewhere its implementation differs. The reason behind this is that India has always considered women as the tender and docile and hence they always giver leverage to women over the verdict. But this should not be done and there should be equality on all fronts, in case the crime is same. However there are certain area where women still enjoy benefit of gender and it very difficult to break through it.

    the government is keen on showing that gender equality is only on papers but practically there is lot of inequality. in case of criminal laws and civil laws women are given priority and coming to the jobs and cadre distribution there is discrimination to the women and men are given priority. so the issue becomes a lot more in a wider perspective than just constricting the view to the laws.

    Article 14-18 of the Indian Constitution provides for Right to Equality. Right to equality itself provides for gender equality. Every individual is equal in the eyes of law but it is not the same in the case of society. Society still looks down upon women as inferior to men. Although it is incorporated in the Constitution, how far is it exercised in the true meaning of the phrase “right to equality”?
