According to Tyabji, on the expiration of the iddat period after talaq the wife’s right to maintenance ceases. Section 125 of the Criminal Procedure Code, 1973 a divorced Muslim Woman is entitled to claim maintenance even after receiving dower money. Though, the Muslim law puts no obligations on the husband once the dower money is paid. After the historic judgment of the case Shah Bano vs. Ahmed Khan in the year 1975, the Hon’ble Supreme Court held that under the holy Quran, a Muslim husband is under obligation to maintain his divorced wife. In the same case, the Hon’ble Supreme Court further held that Section 125 and 127 of the Criminal Procedure Code, 1973 do not provide any exemption to the husband even if he is governed by any personal law. Hence a divorced Muslim Women is entitled to claim maintenance under these sections.
